Entering into the Reference

Until the Arbitrator enters into the reference of the dispute he or she has no powers (other than to enter or not enter into the reference).

Typically before entering into the reference the Arbitrator will set out all the matters which may form a basis of any allegation of bias so that the parties can consider same.

The Arbitrator typically enters into the reference upon determining that he or she has jurisdiction.
